Facts:
An Information was lodged by Stipendiary Steward Mr JM Muirhead against Junior Horseman Mr J Dickie alleging that Mr Dickie used his whip excessively driving Soul To Squeeze over the concluding stages of Race 5.
Rule 869(2)(a) states:
"No Horseman shall during any race use his whip in an unnecessary, excessive or improper manner.”
Mr Dickie had indicated that he admitted the charge but that he wished to be present for the Hearing.
Mr Muirhead demonstrated the incident by use of the video film and he said that Mr Dickie used his whip 22 times in the last 250 metres. Mr Muirhead said that the offence was at the medium to lower end and that Mr Dickie was not overly vigorous with the use of the whip but it was simply used too many times. Mr Muirhead said that Mr Dickie had one similar offence in July last year but he did have a good record.
Mr Dickie for his part acknowledged the use of the whip but said that the use of the whip in the last stage of the race was merely flicking the whip over the tail cropper.
Mr Mangos on behalf of Mr Dickie said that the use of the whip was not consistent over the last 200 metres and that Mr Dickie had paused, albeit briefly, twice.

Mr Muirhead said that the JCA Guidelines recommended a fine of $250.00 and that because Mr Dickie was a Junior Horseman he was suggesting a fine of $200.00.
Mr Dickie for his part said that he had admitted the charge simply because of the number of times the whip was used but not because of the manner in which the whip was used.

Reasons for Penalty:
The Committee viewed the films and noted the brief pauses early in the straight and also the use of the whip over the tail cropper towards the finish of the race. This was an offence that did not look bad but however, the number of times that the whip was used was excessive and this was acknowledged by Mr Dickie. Mr Dickie is a successful Junior Horseman who has a very good record and he has been given credit for his record and also for the fact that he has admitted the charge.
