The Committee imposes a fine of $400.00 on Licensed Trainers M Purdon & G Payne.

Charge:

Breach of Rule 865(2) - Gear Notification

Facts:

An Information was lodged by Stipendiary Steward Mr BJ van Kan against Trainers M Purdon & G Payne alleging that they presented I CAN DOOSIT to race without the notified blinds.

Mr Purdon advised this Committee that he did admit the breach and he was present at the hearing.

Mr an Kan advised that this charge had been brought before the Committee because it was the 9th breach of this Rule by the Purdon/ Payne Partnership since February of this year.

Mr Purdon said that he had been held up at his Stables this morning working with his other horses and as a result he was short of time when he got to the track and had not checked the gear properly. He said that one of his Staff members came down with the horse. He also said that when he was out on the track he was told that the blinds were not attached and he returned to the Stabling area to rectify this. He said it was done in plenty of time and the horse raced with the blinds on.

Submissions for Penalty:

Mr van Kan said that this was a Group race and also pointed to the number of breaches of this Rule by the Purdon/Payne partnership.

The Partnership was fined $300.00 for a breach only 8 days previously. He said that because of the Partnership's record he submitted that a fine of $500.00 was appropriate on this occasion.

Mr Purdon submitted that the Rule was a stupid one.

Reasons for Penalty:

The Committee has listened to the submissions and has also reviwed the record of the Purdon/ Payne Partnership in respect to this Rule. This is the 9th breach since February of this year.

Mr Purdon 8 days ago used the excuse of the number of horses that he had racing that night but tonight he has no such excuse because I CAN DOOSIT is the only horse he has racing at this meeting.

This is the 3rd breach by the Parnership  this month and in approximately 6 weeks prior to tonight breaches have cost the Partnership $1200.00.

This Committee would expect a professionally run stable to have a checking system in place.

The increasing  level of fines imposed does not appear to be having an effect on the Purdon/Payne Partnership and future JCA Committees may need to look at other options.

The Committee has taken seriously Mr van Kan's submission as to penalty but has also spoken to Mr Purdon at this hearing about the many breaches of this Rule and the need to have a designated person in charge of gear. The Committee hopes that Mr Purdon will heed this advice.
