An information instigating a protest lodged by Stipendiary Steward Mr T Taumanu on behalf of INAUGURATION driven by Ms N Chilcott, placed last, against BLOSS’S FLAME, driven by Mr M McKendry, placed 4th on the grounds of interference at the entrance to the home straight.

Mr S Doody, trainer, represented the connections of BLOSS’S FLAME.

Mr Taumanu demonstrated the incident by use of the video film.  He said BLOSS’S FLAME moved outwards abruptly from four back on the marker pegs on to INAUGURATION which had MISTER M, driven by Mr M Burley on its outside.  INAUGURATION broke and lost all chance.

Stipendiary Steward Mr J Muirhead gave similar evidence from his observations of the incident.

Ms Chilcott said INAUGURATION was checked by BLOSS’S FLAME.  INAUGURATION had nowhere to go – Mr McKendry’s sulky hit INAUGURATION’s back leg – INAUGURATION’s chances were abolished – the horse was travelling okay at the time.

Mr Doody said BLOSS’S FLAME was travelling better than INAUGURATION.  Mr McKendry admitted that the outward movement of BLOSS’S FLAME caused INAUGURATION to “tangle”.

DECISION AND REASONS

The video film clearly showed that the outward movement of BLOSS’S FLAME resulted in contact between its sulky and INAUGURATION and in turn caused that horse to break and lose its chance.  The film confirmed the evidence of Mr Taumanu, Mr Muirhead and Ms Chilcott.  The effect of Mr McKendry’s evidence was to concede the protest was properly made out.  The protest is upheld.  Because the chances of INAUGURATION were eliminated I exercise my discretion under Rule 1003 (2) (a) to disqualify BLOSS’S FLAME, the horse having breached Rule 869 (4).
