DECISION AND REASON:
--An information instigating a protest was lodged by Stipendiary Steward, Mr T Taumanu, against MARK ANDREW, driven by Mr B Taylor, placed 6th by the Judge, (but promoted to 5th following the disqualification of IWI ALEX), on the grounds of breaking from its gait free of interference and galloping for about 80 metres before regaining its proper gait about 50 metres from the finish of the race.
--Mr B Taylor, part owner, trainer and driver endorsed the information "I do not contest this protest". He did not wish to attend the hearing.
--Stipendiary Steward Mr J Muirhead demonstrated the incident by use of the video film. MARK ANDREW broke free of interference in the home straight and galloped for about 80 metres before regaining its proper gait about 50 metres before the finish of the race.
--In circumstances such as this, the Breaking Horses Regulation requires the offending horse to be relegated or disqualified. In accordance with the regulation and usual practice, I disqualify MARK ANDREW. The placings then being:
--1st ALLEGRO AGITATO
--2ND BRAIG
--3RD GALLEONS SUNSET
--4TH ILLIN
--5TH SUSAN
