An Information was lodged by Stipendiary Steward Mr TW Taumanu against the third placing of Kahuna Bromac (Driver DJ Butcher) on the grounds of breaking and continuing in a break in excess of 50 metres with approximately one hundred metres to run.

--The protest was contested.
--Present at the Hearing were Mr CP Evans the Owner of Kahuna Bromac and Driver DJ Butcher.
--The applicable Rules were read out and Mr Evans acknowledged that he understood the Rules.
--Rule 870(1) states:
“When any horse breaks from its gait in any race its Horseman shall immediately take all reasonable steps to return it to its proper gait and where clearance exists immediately take such horse clear of the field.”
Rule 870(3) states:
“Any horse which breaks from its gait shall promptly retain its proper gait.”
The relevant parts of the Breaking Horse Regulations state:
“Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.”
The Regulations also give this Committee the power to disqualify the offending horse from the race under Rule 1003(2).
--Evidence was given by Stipendiary Steward Mr NG McIntyre and he showed the position of Kahuna Bromac racing outside the Leader and then going into a break with approximately 100 metres to run. Mr McIntyre then made use of the track pylons to demonstrate the distance that Kahuna Bromac had galloped. He stated that the pylons were 18.3 metres apart and by use of the pylons showed that Kahuna Bromac had galloped in excess of 50 metres.
--Mr Evans was asked to give evidence and he acknowledged the calculation of the distance that his horse had been in a break.
--Mr DJ Butcher was asked to give evidence and he had no hesitation in saying that Kahuna Bromac had galloped for at least 50 metres.
--The Committee then reviewed the video films of the incident and the films quite clearly showed that Kahuna Bromac had galloped in excess of 50 metres.
--The Committee accordingly upholds the protest and Kahuna Bromac is disqualified from the race.
--The amended placings are now:
first - No 5 They Alluvem
second - No 9 Rico Gear
third - No 3 God Knows
fourth - No 4 Whiteland Star
fifth - No 2 Sean Phillip and
sixth - No7 Tarpeia Midfrew.
