Charge:

Failing to maintain position behind the mobile barrier

Facts:

Following race 10 Mr Taumanu lodged an information charging Junior Driver K Blakemore with failing to maintain her position behind the mobile barrier on horse Sixpence with the horse being approximately 3 lengths off the mobile barrier at the point of despatch.

Miss Blakemore appeared for the hearing supported by licensed horseman Mr L Hollis.  She admitted the breach and endorsed the information accordingly.  She confirmed that she was familiar with the rule.

Stipendiary Steward Mr S Wallis referred to film footage of the commencement of race 10 and identified Miss Blakemore on Sixpence at mobile barrier position 7.  At the point of the green light indicating the start of the race Sixpence was clearly approximately 3 lengths adrift of the barrier arm.  The horse was not hanging or pacing roughly and there was no reason for her not to be on the barrier.  Miss Blakemore had  179 total lifetime drives with 26 this current season.

Miss Blakemore admitted she should have tried harder to get on the gate.

Submissions for Penalty:

Mr Taumanu told the committee the starting point for this breach was $250 but her junior driver status should be taken into account.  The breach was  below midrange and she had an otherwise good driving record.  She had an obligation to be on the gate at the time of despatch.  Miss Blakemore also had the option of suspension  in lieu of a fine.

Miss Blakemore through Mr Hollis explained that they had discussed the penalty options.  Miss Blakemore preferred a fine as penalty and realised she had made an error of judgement and  admitted the breach.  This was her first charge and she was getting regular drives.

Reasons for Penalty:

Taking into account Miss Blakemore's junior driver status, the fact that this was the first time she had appeared before the Judiciary and her admission of the breach the committee agreed that a fine was appropriate.
