An Information was lodged by Stipendiary Steward Mr T TAUMANU alleging that horseman J BARNES drove FIELD DAY carelessly causing interference to CARIAD (P FERGUSSON) this interference occurring towards the first bend.

Mr Barnes admitted the charge and was present for the hearing.

Mr Muirhead gave evidence supported by video footage from the start of the race which showed  Mr Barnes drift back and  Mr  Fergusson drawn 2 on the second line move down to the running line inside Mr Barnes.

Mr Barnes has come in on and cramped him up Mr Fergusson who was at that stage half a length ahead.  Mr Fergusson has called for room and Mr Barnes has been unable to move back out as his position had been taken by a horse moving down from three wide.

Mr Fergusson runs out of room and is checked his horse is forced over the pylons and breaks up.

Mr Muirhead in submissions said the normal penalty was up to two weeks for a first offence.  Mr Barnes was an experienced driver had recently returned to driving after a considerable break and had no previous breaches.

Mr Barnes said he had driving commitments for Easter and with a number of workout drives and was picking up a number of outside drives that were looking to race in the next two weeks.

--

Subsequently Mr Barnes is suspended from the conclusion of racing on the 22nd March until the end of racing on the 29th March effectively three days.
