As the breach was admitted, the charge was found proved.

Breach of Rule 857(7)(g) – Failing to come up and maintain barrier position.
Facts:
An Information was lodged by Stipendiary Steward Mr NG McIntyre against Horseman Mr PJ Davis alleging that Mr Davis in Race 1 failed to come up and maintain his barrier position when driving FLY THE FLAG.
Mr Davis was present at the hearing and admitted the charge.
Mr McIntyre demonstrated the incident by use of the video film and showed that Mr Davis drew the outside of the barrier and that he was not up with the field at any stage and at the point of dispatch was several lengths behind the barrier.
Mr Davis in response said that his horse does reef and pull at the start and he was trying to take it up carefully and he misjudged it. He accepted that he had made an error and had admitted the charge.
He did say however that he expected the Stipendiary Stewards to properly police the Rule and charge others in the same position.
Submissions for Penalty:
Mr McIntyre in making submissions as to penalty referred to the JCA Guidelines which provide for a penalty of four drives or a fine of $250.00. He pointed out however that this was a Group 1 Race on a Group 1 Day and the Committee should take this into account.
Mr Davis for his part said that he had admitted the charge and that it did not affect any other horse or horseman.
Reasons for Penalty:
The video footage is clear and Mr Davis was some way off the mobile barrier at the point of dispatch. He did not appear to be having any difficulty with his horse.
He has admitted the charge and has been open and straight forward with his evidence.
The Committee in delivering penalty advised Mr Davis that the JCA Guidelines provide for starting point penalties for standard race meetings and that the Committee believed that for a Group 1 Race the starting point would be higher.
The Committee will be consistent however with the previous decision from Race 1 and will impose a similar fine on Mr Davis.
