Rule 869 : An Information instigating a protest was lodged by Stipendiary Steward Mr T Taumanu following the running of Race 2 on behalf of the Connections of  Horse 2  BOW STREET RUNNER (T Mitchell) placed 5th by the Judge, against Horse 5 STERLISH (D Butcher) on the grounds that it interfered with Bow Street Runner about 400 metres into the race.

Mr Mitchell represented the connections of BOW STREET RUNNER.

STERLISH was represented by Driver Mr D Butcher, Trainer Mr G Small and part owners,Mr and Mrs McKay and Mr McLuckie.

Mr Taumanu gave his view of events and showed video footage of the early stages of the race.  He described BOW STREET RUNNER as running a bit rough into the first turn in the trail with STERLISH immediately outside and looking to take the trail.  Through the first turn Mr Mitchells horse paced roughly for a few strides and this enabled Mr Butcher to slot into the trailing position.  Mr Butchers horse, drawn 5, had started very well and was endeavouring to get to the front.  He was outside Mr Herlihy on the lead horse when he started to ease and go in.  At this point Mr Mitchells horse ran rough and the gap between first and second widened allowing Mr Butcher to slot in.

 Mr Mitchell said was entitled to be in the trail and was about one and a half lengths back and yelled at Mr Butcher when he saw him trying to ease in.  Mr Butcher kept moving in and checked his horse with contact with Mr Butcher’s Sulky wheel which cost him the trail to Mr Herlihy on TEX BROMAC.

Mr Butcher said that Mr Mitchell’s horse had been running rough into the corner and wasn’t keeping up with TEX BROMAC.  He wasn’t looking to drop into the trail the gap just appeared.

Mrs Mckay suggested that the early pace may have contributed to the failure of the horses to maintain their lines

Mr Small suggested that BOW STREET RUNNER part way through the first turn had began running out slightly and had not run roughly until STERLISH was past Mr Mitchells horse.

Mr Taumanu concluded that from his perspective the question was whether the interference if it had occurred was sufficient at an early stage of the race to have had a major bearing on the chances of BOW STREET RUNNER.

DECISION AND REASONS

--

 

--

1.         From the early stages of  the race Bow Street Runner driven by Mr Mitchell was in the trail to TEX BROMAC (Mr Herlihy).  Mr Mitchells horse was running roughly going into the bend with STERLISH (Mr Butcher) on its immediate outside.  Shortly after with STERLISH improving there appears to have been some interference between the two, the cause of which may have been the inward movement of STERLISH.

2.         The unstable gait of BOW STREET RUNNER prior to this and subsequently raises doubt that this action was the sole cause of the result

3.         The net result however was that BOW STREET RUNNER paced roughly and the gap between first and second widened with Mr Butcher electing to take the trail.

4.         This activity took place  about 400 metres into the 2200 metre race and taking into account all matters raised including the distance left to run in the race I am satisfied that interference did occur but that the extent or it effect is not sufficient to warrant upholding the protest.

5.         Accordingly the Protest is dismissed and the Judges placings stand.
