An Information was lodged by Stipendiary Steward Mr TW Taumanu against the third placing of Bettors Image (Driver M White) on the grounds of breaking free of interference with 1400 metres approximately to run and as a result causing interference to Lee Mer (Driver N Chilcott) and Gene Genie (Driver D Butcher).

An Information was lodged by Stipendiary Steward Mr TW Taumanu against the third placing of Bettors Image (Driver M White) on the grounds of breaking free of interference with 1400 metres approximately to run and as a result causing interference to Lee Mer (Driver N Chilcott) and Gene Genie (Driver D Butcher).

The protest was contested.

Present were Mr M White, the Driver of Bettors Image and Mr D Iremonger, the Trainer of Bettors Image.

Also present was Ms N Chilcott, the Driver of Lee Mer.

--

The relevant part of Rule 869 provides under 869 (4a) “no horse shall during any race do anything which interferes or is likely to interfere with any other horse or its progress”.

Stipendiary Steward Mr JM Muirhead demonstrated the incident by use of the video film.  He showed where Bettors Image driven by Mr White was three back on the pylons and that Ms Chilcott’s horse was behind it but on the outside.  Mr Muirhead showed where Bettors Image broke free of interference and when in a gallop it interfered with Lee Mer and there was resulting interference to Gene Genie.

After viewing the films the Committee asked Mr Iremonger if he wished to continue to contest the protest and he said that he did not.

Decision

--

On the basis that this protest is now not contested the Committee disqualifies Bettors Image from the race and the amended placings are now:

--

1st (2) Extended Credit
2nd (3) Kozaroza
3rd (5) Anvil Beirnes
4th  (1) Contessa Adoro
5th (4) Brookfield Talent
