An information was filed following race number 8 alleging a breach of rule 869 (3) (b), the informant was Mr.T.W.Taumanu and the defendant Mr.R.Fensom.
--The information stated that Mr.R.Fensom the driver of "CHARLIE REIGN", drove carelessly when he drove into the back of "HASTILEA", which had been in a gallop for approximately 100 meters of the concluding stages of the race.
--Mr.Fensom admitted the breach of this rule and was present at the hearing.
--Mr Muirhead showed the video of the concluding stages of the race and this clearly showed Mr Fensom to run up the back of Hastilea as outlined in the information.
--Mr Muirhead who stood in for Mr Taumanu asked for a suspension of two weeks and stated that Mr.Fensom had a clear driving record.
--Mr.Fensom made submissions on penalty and also asked for a suspension of his horseman’s licence.
--Decision and Reasons.
--As the information was admitted by Mr.Fensom and having taken into consideration the clear driving record of Mr.Fensom this Judicial Committee orders that the horseman’s licence of Mr.Fensom be suspended for a period of two weeks up to and including the 1st February 2009.
