DECISION & REASON

An information lodged by Stipendiary Mr T Taumanu against Mr M Pash, driver of EASTBURN GEE, alleging a breach of Rule 869 (2) (a) in that he used his whip excessively on his horse over the concluding stages of the race. Mr Pash admitted the breach and was present at the hearing.

Mr Taumanu said Mr Pash hit his horse 22 / 23 times with the whip in the home straight. He said it looked bad and was bad. Mr Pash accepted Mr Taumanu's account. He said the horse was lazy and it was necessary to be "very firm" with it.

PENALTY

--

Mr Taumanu said Mr Pash had been fined $200.00 for a breach of the rule on 15 June 2007. He suggested a 2 week suspension of Mr Pash's horsemans licence - consistent with other recent penalties for a second breach of the rule. Mr Pash asked to be dealt with as leniently as possible. In fixing penalty I took into account the following matters :

  1. The guilty plea - although this was somewhat inevitable.

  3. The previous recent breach of the same rule.

  5. The submissions of Mr Taumanu.
  6. --
  7. The submissions of Mr Pash.
  8. --
  9. The offending was mid range on the scale of seriousness.

  11. Recent penalties imposed for a second breach of the rule.

Balancing those matters, I suspended Mr Pash's horsemans licence for 2 weeks - to the end of racing on 25 July 2007.
