DECISION & REASON
--An information instigating a protest lodged by Stipendiary Steward Mr Taumanu under Rule 869 (7) (b) against LORD JAKE, driven by Ms N Chilcott and placed 4th by the judge on the ground that its sulky wheel moved inside the track marker line for more than 30 metres in the last 600 metres of the race, namely from about the 450 metre mark to about the 300 metre mark. Mrs H J McQueen, part owner, on behalf of the connections, endorsed the information "Do not wish to contest protest".
--I heard the evidence regarding this matter during the related driving charge against Ms Chilcott - a breach I found to be proven. In brief, it was the driving of Ms Chilcott which caused the sulky wheel to move inside the marker line. In these circumstances the rule requires mandatory disqualification. I therefore disqualify LORD JAKE, the final placings then being :

--2nd EMILIA
--3rd ENDEAVOR
--4th INDIAN WELLS
--5th SUNWISE
--6th PRIDE OF THE LAND
