An information lodged by Stipendiary Steward Mr T Taumanu against Mr S L McCaffrey, driver of WAINGARO INVADER, alleging a breach of Rule 867 in that he failed to keep both his feet in the footrests
An information lodged by Stipendiary Steward Mr T Taumanu against Mr S L McCaffrey, driver of WAINGARO INVADER, alleging a breach of Rule 867 in that he failed to keep both his feet in the footrests over the concluding stages of the race. Mr McCaffrey admitted the breach and was present at the hearing.
--Mr Taumanu demonstrated the breach by use of the video film. Shortly after the entrance to the home straight, Mr McCaffrey's right foot came away from the footrest and remained out of the footrest until just prior to the finishing line. Mr McCaffrey was able to drive his horse out to the finish of the race, including using the whip, and the horse improved from near the tail of the field to finish third.
--Mr McCaffrey said it was a wet and slippery night and he did not realise his foot was out of the footrest until shown the film. He said his actions did not cause harm to any other runner.
--Mr Taumanu said Mr McCaffrey has a clear driving record apart from a warning by Stipendiary Stewards for a breach of the same rule on 1/2/07. He said the standard fine for a first breach of this rule was $100.00 but in view of the warning, he recommended a fine of $200.00. Mr McCaffrey asked that his explanation be taken into account when fixing the fine.

- The submissions of Mr Taumanu. --
- The submissions of Mr McCaffrey. --
- Mr McCaffrey's clear driving record. --
- The circumstances of the breach, in particular that the foot was out of the footrest for about 200 metres at a vital stage of the race, a factor which it was concluded warranted an increase on the standard fine.
Taking all of those matters into account, a fine of $150.00 was imposed.
