Facts:

Following the running of Race 8 Stipendiary Steward Mr S Wallis lodged an information instigating a protest against Horse 7 DEREK CLARKE driven by Mr D Butcher and placed 4th by the judge on the grounds that it broke from its gait in excess of 150 metres from about the 400 metre mark through the final straight.

Mr Butcher appeared on behalf of the connections of Derek Clarke and endorsed the information confirming he did not contest the protest or any subsequent disqualification.

The judge's placings were:

Mr Wallis referred the committee to video footage of the concluding stages of the race and identified horse 7 Derek Clarke driven by Mr D Butcher.  With about 400 metres to run Derek Clarke broke and galloped in excess of 150 metres over the concluding stages in clear breach of the Breaking Horses Regulations and Rule 870.  Mr Wallis sought the disqualification of the horse.

Reasons for Decision:

Derek Clarke had clearly breached the Breaking Horses Regulations and Rule 870(3).
