Following Race 4 an Information was filed pursuant to rule 638 (1) (e).  The Informant, Mr M Williamson alleged that Mr P Ormsby, rider of SMOKE, was guilty of incompetent riding when entering the straight on the first occasion.  He said that near the 2800 metres Mr Ormsby failed to follow the course as directed and explained to all riders prior to the race.  This error resulted in Mr Ormsby taking the wrong course forcing him to retire SMOKE from the race.

Mr Ormsby admitted the breach and when asked if he would like representation at the enquiry he declined the offer.

Before asking Mr Coles to demonstrate the video films, Mr Williamson told the Committee that, prior to the race, Mr Coles explained the course to all riders.  When asked if they understood the instructions all riders were happy.

FACTS:

--

Mr Coles demonstrated the video films which showed the field jumping the fence at the 700 metres.  At this stage SMOKE was clearly in front but immediately after jumping the fence when Mr Ormsby should have angled his mount in to approach the inside fences, he carried on straight ahead.  The film showed the remainder of the field angle in at which stage Mr Ormsby had no option but to pull his mount up as he was well out of the race.

Mr Ormsby had little to say in way of explanation other than to admit he was too far the past the gap when he realized his mistake.

SUBMISSIONS ON PENALTY:

--

Mr Williamson said this was Mr Ormsby’s first ever charge and this was his first steeplechase ride at Te Rapa.  However he said this was a relatively serious charge and a gross error of misjudgment on Mr Ormsby’s part.  He said the ramifications were far reaching with the betting public affected as well as the negative publicity resulting from the incident.  However Mr Williamson affirmed that Mr Ormsby had been fully cooperative with the stewards and there was no willful intent in his actions.

REASON(s):

The Committee carefully considered all evidence and submissions before imposing an appropriate penalty.  Mitigating factors are Mr Ormsby’s guilty plea, this was his first steeplechase ride at Te Rapa, he had been fully cooperative with stewards and there was nothing willful in his actions.  However the aggravating facts are equally important.  These include the possible serious losses incurred by the betting public and the horses’ connections.  Professionalism is most important in our industry and this was gravely compromised on this occasion through Mr Ormsby’s actions.

PENALTY:

Taking all the above factors into account we impose a suspension on Mr Ormsby from riding in races which is to start after racing on 10 July 2010 and conclude at 5.00 pm on 10 August 2010 - (1 month).
