This is a protest lodged by apprentice M Cameron alleging interference by number 1, LORD JIMMY MELLAY placed second by the Judge affecting the chances of BRUGRAWAY, number 6, placed third by the Judge in respect of race one on 30 April 2005 at Te Rapa.

The protest was lodged pursuant to Rule 876(1) and seeks relegation of LORD JIMMY MELLAY. It was lodged in accordance with Rule 1107(2) within two minutes of the last to be weighed in of the riders of the horses placed by the Judge being weighed in.

The first question which we are required to consider is whether BRUGRAWAY was interfered with and whether LORD JIMMY MELLAY caused that interference as alleged.

The Committee heard evidence from apprentice jockey M Cameron, rider of the third horse BRUGRAWAY. He said that LORD JIMMY MELLAY moved out causing interference.

--

Mr A Peard, rider of LORD JIMMY MELLAY, said he did not cause interference, if anything there was movement from the outside horse, number 2.

--

We are not satisfied that interference occurred. Accordingly, the protest is dismissed.
