Following race 9 an information was filed pursuant to Rule 912(1) requesting a ruling as to whether BALLYMORE LASS was denied a fair start due to a gate malfunction.

Following race 9 an information was filed pursuant to Rule 912(1) requesting a ruling as to whether BALLYMORE LASS was denied a fair start due to a gate malfunction.

Mr Coles, Stipendiary Steward, demonstrated the video film which clearly showed the gate from which BALLYMORE LASS started was slow to open and was in fact still shut when all the others were open. He stated the horse was denied a fair start due to the gate malfunction.

Mr R Allwood, rider of BALLYMORE LASS, said his gate was definitely slow to open and he had to barge his way out which cost him a few lengths.

Mr P Moroney reinforced Mr Coles' evidence and said the video was clear showing his horse was denied a fair start.

Mr Humphries, the starter, said he was in front of the gates at a slight angle and he noticed one horse slightly slow to start. He said that normally the pair of gates are slow which led him to believe it could be a broken rubber which he will check.

The Committee carefully considered all evidence and are satisfied that BALLYMORE LASS was denied a fair start due to the malfunction of its starting gate. Accordingly we order the refund of all monies on BALLYMORE LASS.
