Decision:

Accordingly and for these reasons the committee is satisfied that the ground lost by O'FILLE was greater than the short head margin between the 2 horses at the post. Therefore we find that if interference had not occurred O'FILLE would have beaten POSTMAN'S DAUGHTER.

The protest is upheld and the result is as follows:

The margin between 2nd and 3rd was a short head.

Following race 8 a protest was lodged pursuant to rule 642.  The informant Mr C George alleged that POSTMAN'S DAUGHTER placed 2nd by the judge interfered with the chances of O'FILLE placed 3rd by the judge.  This interference is alleged to have occurred in the final straight. 

Submissions for Decision:

Mr George demonstrated the video films and pointed out to the hearing POSTMAN'S DAUGHTER  moving out in the concluding stages and interfering with the rightful line of O'FILLE.  He stated that O'FILLE was racing in advance of POSTMAN'S DAUGHTER at the time she received a bump which occurred at the 150 metres.  Mr George said there was a second bump between the 2 horses closer to the finish.  He submitted that in the opinion of the stewards O'FILLE would have beaten POSTMAN'S DAUGHTER  if she had not been hampered. 

Mr Harris, rider of O'FILLE, said Mr George had summed up the interference fairly.  He stated POSTMAN'S DAUGHTER had come out and bumped O'FILLE on 2 occasions, the first of which caused his mount's back legs to be taken away.  Mr Harris concluded by saying he may well have won the race if he had not received interference.

Mrs Waaka said Mr Dell had not stopped riding and had kept banging into O'FILLE. 

Mr Dell, rider of POSTMAN'S DAUGHTER, said he had been riding vigorously and had run out under pressure.  He admitted contact had occurred but he had been headed by O'FILLE and came back to finish a short head in front.  Mr Dell stated he did correct his mount.

Mr Walker said that POSTMAN'S DAUGHTER came from behind O'FILLE and could not understand how she could be relegated.

In answer to a question from the committee Mr Walker acknowledged that there was contact on 2 occasions.

Reasons for Decision:

The Committee carefully considered all evidence and submissions and reviewed the video films several times. It was clearly evident that at the 300 metres POSTMAN'S DAUGHTER was 3 off the rail and at the 150 metres was 7 off the rail after being ridden hard with the whip. This outward movement resulted in POSTMAN'S DAUGHTER bumping O' FILLE causing her back legs to be spun around. Prior to the contact O' FILLE was a neck ahead of POSTMAN'S DAUGHTER and due to the bump lost approximately half a length.  In addition there was a second bump to O'FILLE shortly after this caused by POSTMAN'S DAUGHTER  moving out and making contact.
