DECISION & REASON
--Following Race 10 an Information was filed by the Stipendiary Steward seeking a ruling in regard of Rule 865A, as to whether the horse NGAHIITI was denied a fair start when the gate to that horses stall failed to open with the rest of the starting field.
--The informant called evidence from the rider of NGAIITI, Mr BR Jones, and the starter, Mr J Humphries. The video recording of the start was viewed following the evidence from the two witnesses.
--The committee accepted the evidence from the jockey that his mount, "had had all chances extinguished" by the gate failure and noted that the video recording confirmed his stance.
--The starter advised the committee that whilst NGAIITI was known to be unruly at the barrier, on this occasion the horse had not presented any problems.
--The committee determined that in terms of Rule 865A, NGAIITI was denied a fair start and ruled in accord with that finding, declaring the horse a non-starter.
--The committee respectfully suggested that the Cambridge Jockey Club address the matter of any appropriate fee/s refund.
