Following race 9 an information was filed by Stipendiary Steward Mr J Oatham, pursuant to Rule 871 (1) (d). He alleges that Mr K Smith, rider of MY ASTRON, permitted his mount to shift out near the 50 metre mark when not clear

Following race 9 an information was filed by Stipendiary Steward Mr J Oatham, pursuant to Rule 871 (1) (d). He alleges that Mr K Smith, rider of MY ASTRON, permitted his mount to shift out near the 50 metre mark when not clear of SENT TO SEA which had to be checked.

Stipendiary Steward Mr A Coles demonstrated the video films and showed where at the 50 metre mark Mr K Smith, rider of MY ASTRON, which was full of running, angle his mount out into a gap and take the rightful line of SENT TO SEA, ridden by C Lammas. Mr Smith was only 3/4 length clear of that runner.

Mr K Smith submitted that there was 1/2 a gap which he elected to take. He said the inside horse also moved out slightly but conceded the check to Mr Lammas was quite bad. He said he does go to the South Island for rides but had no firm commitments.

Mr Oatham produced Mr Smith's record, which showed no charges in the last 12 months. However, he said the check to SENT TO SEA was quite a severe one and the degree of carelessness was at the higher end. He said it warranted a 5 - 7 day suspension.

DECISION :

The Committee considered all submissions and, before imposing penalty, took into account the following factors :

  1. Mr Smith's excellent record.
  2. --
  3. His early admission of guilt.
  4. --
  5. The interference to SENT TO SEA which was checked quite sharply.
--

Accordingly, we impose a suspension to start after racing on 30 April 2008 and conclude after racing on 10 May 1008 (6 days).
