As Mrs Satherley has admitted the breach we find the charge proved.
Penalty:
Accordingly the Committee imposed a fine of $500 on Mrs Satherley.
The Committee informed Mrs Satherley that a further breach of this Rule prior to the 24 February 2019 would attract a suspension with a starting point of between 6-8 days.
Facts:
Following the running of race 3, the Porritt Sand 1600, an Information was produced where Mr McLaughlin alleged that Mrs Satherley used her whip excessively when riding MANGAROA RIPPER prior to the 100 metres.
Mrs Satherley was present at the hearing and acknowledged that:
(a) she understood the Rule, and that
(b) she admitted the breach.
Rule 638(3)(b)(ii) states:' A rider shall not strike a horse with a whip in a manner or to an extent which is excessive'.
Using the available films Mr Williamson identified the horse MANGAROA RIPPER, ridden by Mrs Satherley as the field entered the home straight. MANGAROA RIPPER was towards the rear of the field near the running rail. Mr Williamson stated that Mrs Satherley struck the horse 9 times with the whip from that position until near the 100 metres mark. Mr Williamson added that Mrs Satherley had given some respite during these strikes however they were not for the required time.
Mrs Satherley said that she had made an error of judgement, and added that she did not consider she had used excessive force with the strikes involved.
Submissions for Penalty:
Mr McLaughlin told the Committee that Mrs Satherley had previously breached this Rule on 24 February 2018, and that since this breach was the 2nd within a 12 month period the Stewards believed that a fine of $500 would be an appropriate penalty.
Mrs Satherley had nothing to say in respect of her likely penalty.
Reasons for Penalty:
The Committee confirmed that a 2nd breach of this Rule within a 12 month period incurred a fine of a starting point of $500. We did not see any reason to consider an uplift from that amount. It was clear that the number of strikes, while excessive because Mrs Satherley did not give the necessary respite, were not administered with excessive force.
