As the breach was admitted we find the charge proved.
Penalty:
Accordingly under the provisions of rule 1106 (2) we suspend Mr Hain from riding in races which starts after the conclusion of racing on 29 April until after racing on 7 May (4 North Island days).
Facts:
Following race 2, Cambridge Equine Hospital Premier, an information was filed pursuant to rule 638 (1) (d). The informant, Mr J Oatham, alleged that near the 350 metres Mr D Hain, rider of STACEY ANN, allowed his mount to shift out when not clear of MISTRAHMA (C Grylls) which was checked.
Rule 638 (1) (d) reads as follows: a rider shall not ride a horse in a manner which the judicial committee considers to be careless.
Mr Coles demonstrated the video films which showed STACEY ANN racing in the trail on the rails behind MASSA LU. Mr Coles pointed out that near the 350 metres Mr Hain angled his mount out from behind MASSA LU and in doing so make contact with MISTRAHMA who was crowded and checked. He said Mr Hain hit his mount when shifting out and he should have taken corrective action at that stage.
Mr Hain said the incident was clear on the films and admitted riding a bit more desperately than he should have.

Mr Oatham told the committee that Mr Hain had a very good record albeit having had only 37 rides up to and including 16 March. He added that Mr Hain had admitted the breach. Mr Oatham said that while this was an error of judgement on Mr Hain's part the consequences were that MISTRAHMA had her chances extinguished. He submitted the breach was midrange and that a 4 to 5 day suspension would be appropriate.
Mr Hain said he had commitments up to and including 29 April.

The committee carefully considered all submissions and evidence. Mitigating factors are Mr Hain's admission of the breach and his good record from limited opportunities. The aggravating factor in this charge is that Mr Hain struck his mount with the whip while shifting ground which caused the sharp check to MISTRAHMA. The committee assesses the breach to be midrange.
After taking all the above into account we find an appropriate penalty to be one of 4 days.
