 Accordingly the protest is dismissed and the judges placing shall stand

The margin between 1st and 2nd was a nose.

Following the running of race 9 a protest was lodged by the informant Mr A Calder pursuant to rule 642(1).It was alleged that USAIN or its rider placed 1st by the judge interfered with the chances of SHIBBOLETH placed 2nd by the judge.The interference occured in the final straight.

Submissions for Decision:

The informant Mr Calder demonstrated the video films and showed at the 350 metre mark a gap opened for 3 or 4 strides before Usain ridden by J. Collett shifted in ½ a horse width. This resulted in Mr Calder having to steady his mount and pull back for a run. He believed the check cost him 1 length.
 
Mr R James, trainer of SHIBBOLETH, said there was no doubt interference did take place and believed USAIN shifted in ½ a horse width resulting in Mr Calder taking evasive action.
 
Mr P Hogan, owner of SHIBBOLETH when asked, said he did not wish to make any comment.
 
Mr Oatham, Stipendiary Steward, showed all parties various angles of the alleged interference.
 
Mr R Collett, trainer of USAIN, reiterated what Mr Calder said in that USAIN movement was ½ a horse width and never at any stage was there a clear horse width. He believed USAIN was dictated from the horse on its outside. He doubts SHIBBOLETH ever had enough room to take the gap.
 
Mr J Collett, rider of USAIN, said his mount was dictated inwards and believed that MR RESURGENT (A. Webb) who was racing erratic on his inside also contributed to the incident. He did not believe there was sufficient room for Mr Calder at any stage.
 
Mr Oatham, Stipendiary Steward, when asked for his interpretation of the protest, said the committee clearly had to determine was there an available gap for Mr Calder’s mount to improve into.
 
Mr Calder said in summing up he believed Mr J Collett had shifted in ½ a horse width and denied his horse the opportunity to get through the gap.

Reasons for Decision:

The committee carefully considered all evidence and reviewed the video films on several occasions. While we concede Mr Calder did have to check his mount at the 350 metres. The head on film clearly shows when slowed down frame by frame that there was a gap that appeared for only 2 strides which Mr Calder was angling for. The primary reason Mr Calder had to check SHIBBOLETH was because there was never sufficient room to allow him to improve. The field was racing in tight quarters at the point of interference with slight movement from horses racing either side of SHIBBOLETH.
 
For these reason we are not satisfied SHIBBOLETH would have beaten USAIN had interference not occurred.
