Following race 6 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr JP Oatham, that MJ Walker, the rider of OLYMPIC LIGHT, committed a breach of that rule

DECISION AND REASON:
--Following race 6 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr JP Oatham, that MJ Walker, the rider of OLYMPIC LIGHT, committed a breach of that rule when he shifted outwards when riding with a drawn whip and not the required distance clear of JUDDEBAR (M Innes) who was forced out onto ANGEL?S WHISPER (M Williamson). Mr Walker did not admit the charge.
--Mrs Innes, the rider of JUDDERBAR, in her evidence said that she received pressure from the inside horse OLYMPIC LIGHT who was ridden by M Walker. She said initially she was rolled out by Mr Walker, they then straightened. Mrs Innes said that he would have been no more the three-quarters length clear. She said there was no pressure from the outside that it all came from the inside.
--Mr Williamson, rider of ANGEL?S WHISPER, said there was movement from both sides but felt that most of the pressure came from the inside. He said he was forced to stand up in his irons and take hold of his mount.
--Mr W Robinson demonstrated the films. He showed the first outward movement at the 300 metre mark. Mr Walker then straightened his mount, then drew the whip again. OLYMPIC LIGHT again moved out when not clear. Mr Walker kept riding his mount until contact was made causing interference to outside horses. He then straightened his mount. Mr Robinson said that he thought that a rider of Mr Walker's experience should have reacted more quickly.
--Mr Walker in his defence said his horse was a difficult ride and it had run off at Te Aroha at its last start. He said that he couldn?t deny that it ran out but he felt that the interference was caused by other horses putting pressure from the outside. He felt he had endeavoured to straighten his horse as soon as it started the outward movement. He demonstrated his actions on the film.
--In summing up, Mr Oatham said that in his opinion Mr Walker allowed his mount to move out and was too slow in taking corrective action.
--The Committee has reviewed the films and all other evidence. Mr Walker admitted that he was aware his mount could be a difficult ride. He found in his initial movements that his horse ran out. He straightened it then again drew his whip. This time the movement was considerable but he did not stop urging his mount until after contact had been made with Mrs Innes' mount, which in turn applied pressure to the horse on her outer. Consequently we find Mr Walker guilty of a breach of Rule 871(1)(d) as charged.
--Penalty:
--Submissions on penalty were received from Mr Oatham who gave Mr Walker's record, which showed no offending in the six months since his return to New Zealand riding. He did, however, ask for a suspension.
--Mr Walker mentioned some important rides and spoke of the inconvenience to owners if he was suspended.
--In coming to our decision on penalty we have taken into account:

- Mr Walker's admission that he was aware that the horse could race greenly --
- Mr Walker's slow reaction for an experienced rider --
- Mr Walker's record
In our view this offence is worthy of a four-day suspension. We cannot give credit for a not guilty plea. We do give credit for one day because you will miss a premier day.
--Consequently we suspend you from riding from the conclusion of racing on 23 November 2005 until the conclusion of racing on the 26 November 2005, 3 days.
