Facts:
Following the running of Race 3, the BAKER/FORSMAN RACING STABLES 1550, Mr B Jones, Stipendiary Steward presented an Information against Mr B Donoghue, the Rider of TOUCH THE CLOUDS, alleging a breach of Rule 638(3)(b)(ii) in that he struck his horse with the whip to the extent that was excessive.
Mr Donoghue admitted the charge.
Using the race films, Mr Jones illustrated to the fact that prior to the 100 metre point, Mr Donoghue struck his mount with his whip 7 times which was beyond the Guidelines well known to Riders. The mount of Mr Donoghue finished 5th.
Submissions for Penalty:
Mr Jones advised that Mr Donoghue had clear record over the past 6 months, have had a breach of this Rule – also in a highweight race, on 15 October 2020. He submitted that a fine of $300, in line with the Penalty Guide, was appropriate.
Mr Donoghue accepted that he should be fined for his lapse.
Reasons for Penalty:
The Committee saw no reason to deviate from the Penalty Guide.
