Decision:

This is an information pursuant to Rule 304 arising from the Cambridge Jockey Club Trials on the 15th May 2008. The Informant Stipendiary Steward Mr Oatham, alleged that Mr J Waddell rode the horse FIDDLERONTHEROOF in an unapproved body protector.

This is an information pursuant to Rule 304 arising from the Cambridge Jockey Club Trials on the 15th May 2008. The Informant Stipendiary Steward Mr Oatham, alleged that Mr J Waddell rode the horse FIDDLERONTHEROOF in an unapproved body protector.

Mr J Waddell admitted the breach.

--

Mr Oatham submitted he became aware that Mr Waddell was wearing an unapproved vest after he was dislodged from his mount on the way to the barriers. It was discovered that the vest was of South African origin and not approved by New Zealand Thoroughbred Racing.

Mr Waddell had nothing to add.

Penalty

--

Mr Oatham produced the charges pertaining to this rule and said there could have been repercussions to Mr Waddell if he had suffered a back injury. He submitted a fine in the range of $750 to $1,000.

Mr Waddell said it was a mistake on his part and brought the wrong vest to the trials. He believed the submissions on fine by Mr Oatham were too high.

Decision

The committee took into account all submissions and before imposing a penalty took into account the following:

--

1: The guilty plea.

--

2:  Mr Waddell’s co operation with the Stewards.

--

3: Submissions of Mr Oatham referring to charges under the rule.

--

 

--

Balancing the above matters the Committee imposed a $750 fine.
