FACTS

Ms Satherley admitted a breach of Rule 638(3)(g)(i).  It was alleged that Ms Satherley struck her mount with the whip 6 times prior to the 100m (5 is the limit).

Ms Satherley said that she understood the Rule, Charge and confirmed that she admitted the breach.

Mr Dooley showed film replays and pointed out where the 6 strikes were applied during the running.

Ms Satherley agreed.

DECISION

As the charge was admitted it was deemed proved.

PENALTY SUBMISSIONS

Mr Dooley said that this was the second breach of the Rule within the last six months.

He referred to the Penalty Guide.

Ms Satherley said that she got a little confused as to where the 100m marker was.

REASONS FOR PENALTY

The Penalty Guide has a starting point of $250 for a second breach in six months.

This amount was considered to be a suitable penalty.

PENALTY

Ms L Satherley was fined $250.
