SUMMARY OF FACTS

Following the running of Race 6 the Applicant, Mr M Brosnan, Trainer of “ARJAY’S FLIGHT” filed an Information instigating a protest pursuant to Rule 642(1) alleging interference in the final straight by “IMPREVU”.

The provisional placings were:

1st – RED VIENNA

2nd – IMPREVU

3rd – ARJAY’S FLIGHT

The margin between 2nd and 3rd was a long head.

SUBMISSIONS FOR DECISION

Ms Thornton, the Rider of “ARJAY’S FLIGHT” said that “IMPREVU” caused her horse severe interference by coming out onto her.  She said that she was forced over about six horse widths and that it certainly cost her horse second placing.

Mr Brosnan the Trainer of “ARJAY’S FLIGHT” said that “IMPREVU” came out 5 or 6-wide, caused severe contact and with the margin being a long head it cost his horse second placing.

Mr D Lunn, part-Owner of “IMPREVU” said that the interference was only for two or three strides and that the other horse was never going to go past.  He said that his horse was running away at the finish and that the other horse was never going to finish second.

Mr C Jones said that he did come out and caused interference, but said that he did not agree that the other horse would have finished second.

Mr Dooley, Stipendiary Steward said that “IMPREVU” came out and forced “ARJAY’S FLIGHT” over extra ground.  He said that the protest had merit.

REASONS FOR DECISION

Near the 100m when both “IMPREVU” and “ARJAY’S FLIGHT” were racing almost abreast, “IMPREVU” shifted out and made contact with ‘ARJAY’S FLIGHT”.  “IMPREVU” continued an outward movement forcing “ARJAY’S FLIGHT” out approximately 6 horse-widths.  During this movement “ARJAY’S FLIGHT” lost balance, but continued to finish strongly to be beaten by a long head for second place.

It was observed that “IMPREVU” was ridden with vigour during its entire outward movement.

After giving due consideration to all relevant matters, including the degree of interference, how both horses finished the race off and the long head margin, the Committee was comfortably satisfied that if interference had not taken place, “ARJAY’S FLIGHT” would have finished in advance of “IMPREVU”.

CONCLUSION

The Protest third against second was upheld.

Placings now read:

1st – RED VIENNA

2nd – ARJAY’S FLIGHT

3rd – IMPREVU

Dividends and prize money to be paid on the amended placings.
