Following the running of Race 2 Stipendiary Steward Mr J Muirhead laid an Information against Horseman I BROWNLEE alleging he drove YEOUN SAN carelessly causing interference

Following the running of Race 2 Stipendiary Steward Mr J Muirhead laid an Information against Horseman I Brownlee alleging he drove YEOUN SAN carelessly causing interference to INNOCENT BYSTANDER (M McKendry), which in turn caused a check to Udare (T Shaw) shortly after the start of the race.

Mr Brownlee admitted the breach and elected not to be present for the hearing.

Mr Muirhead gave evidence and referred to video footage of the start of the race which showed Mr Brownlee cross over Mr McKendry's path turning into the first bend, when he appeared to momentarily

lose control when pulling the pins.

Mr Mc Kendry had no room and was forced inwards checking Udare

Mr Muirhead said that a mitigating feature had been the initial outwards movement of UDARE immediately after the start of the race but this had no major impact on the checking it suffered.

Mr Brownlee endorsed the information suggesting the charge was very harsh considering the circumstances.

From the evidence given and taking into account the guilty plea the charge was established.

Although there was initial outward movement by UDARE from barrier one which had moved INNOCENT BYSTANDER out it had moved back inwards prior to the actions of YEOUN SAN.

The action of Mr Brownlee in choosing to go forward and subsequently cutting across the path of INNOCENT BYSTANDER was careless and had caused interference to both Innocent Bystander and Udare.

Mt Brownlee had no recorded similar breaches in the past 12 months of approximately 100 drives

Taking into account his early admission of guilt, his driving record and the mitigating factors
