An information lodged by Stipendiary Steward Mr T Taumanu, against Mr I Brownlee, driver of GET JIGGY WITHIN, alleging a breach of the above rule in that he did not ensure that his sulky did not protrude inside the marker line. The allegation was as explained in the associated protest hearing, namely that Mr Brownlee's sulky wheel travelled inside five track markers within the last 600m of the race, and also inside the last track marker prior to the passing lane. Mr Brownlee admitted the breach and was present at the hearing. Mr Taumanu asked that his evidence at the protest hearing be accepted as evidence for this hearing. Mr Brownlee did not object and that request was granted.

Mr Taumanu said that Mr Brownlee had a breach of the rules for careless driving recorded against him on the 7 July 2005, when he was suspended for two days. Mr Taumanu suggested a fine of $250 or a suspension. Mr Brownlee said that he felt he was being picked on but said he would accept a fine of $250. In fixing penalty the following matters were taken into account ?
