Following the running of Race 6, Stipendiary Steward Mr T TAUMANU, lodged an Information instigating a protest against Horse 7, AQUA BLAST (DRIVER F COONEY) placed 1st by the Judge on behalf of the connections of Horse 2 ANALYST (DRIVER T MITCHELL), placed 3rd, on the grounds of a breach of Rule 869 and the Passing Lanes, False Rail and Home Straight Regulations

Mr Mitchell represented the connections of ANALYST and Mr Cooney was supported by

--

Owners of AQUA BLAST, Messrs Haslam, Outrim and Bridgford

--

Stipendiary Steward Mr J Muirhead gave evidence and referred to video footage of the concluding stages of the race.

--

He submitted that AQUA BLAST as the leading horse had failed to maintain a straight course and thus denied trailing horses full access to the expanded inside line in breach of Para 4, 6, and Para 7 of the referred Regulations. In doing so AQUA BLAST had also breached Rule 869(4) by interfering with the progress of ANALYST.

Video evidence clearly showed AQUA BLAST leading coming into the home turn and after passing the start of the passing lane to drift inwards and in front of ANALYST who had moved into the passing lane properly. In the closing stages Mr Mitchell was seen to take hold of his drive as a result of the inwards movement of AQUA BLAST into the passing lane.

Mr COONEY agreed that his drive had moved into the path of ANALYST but claimed that ANALYST had been under a hard drive and was unlikely to have improved on its third placing.

Mr MITCHELL gave evidence of the closing stages supporting the Stipendiary Stewards contentions and in response to questioning from Mr COONEY said that AQUA BLAST's

--

Actions forced him to take hold of his drive, clearly costing him a length over the finishing stages and second placing over the line.

--

The Protest was upheld on the grounds of a clear breach of the relevant regulations and Rule 869 in that it had been established that AQUA BLAST as the leading horse had failed to maintain a straight course to the finish line and thus had failed to allow ANALYST full unimpeded access to the passing lane and in doing so had interfered it progress

--

Accordingly pursuant to Rule 869(8) the Judges placings are amended, with AQUA BLAST relegated to third place behind ANALYST.
