Following the running of race No 1 information was filed alleging a breach of rule 869(3) (b) "careless driving" the informant was Mr T W Taumanu and the defendant Mr J Abernethy Jr

Following the running of race No 1 information was filed alleging a breach of rule 869(3) (b) "careless driving" the informant was Mr T W Taumanu and the defendant Mr J Abernethy Jr horseman. The Information alleged that Junior horseman Mr J Abernethy drove carelessly improving Aaron David where there was insufficient room in between Highly Operative (J Stormont), and Steffie Jane (S Doody), causing his own horse to break with approximately 175 meters to run.

Mr Abernethy was present at this hearing and admitted the breach of this rule; Mr B M Mangos was present to assist Mr Abernethy as a senior horseman.

Mr Mangos on behalf of Mr Abernethy made submissions of mitigating factors he wished the Judicial Panel to note in this instance. Mr Taumanu showed the video of this incident and acknowledged the mitigating factors which Mr Mangos pointed out.

These factors were that Aaron David had been traveling very well at this point of the race and had ducked into a gap and caught Mr Abernethy off guard striking the wheel of Highly Operative and causing Aaron David too break from its gait.

Submissions were presented on penalty from both Mr Taumanu and Mr Abernethy . The driving record of Mr Abernethy was produced for perusal. Mr Taumanu believed that this offending was at the lower end of the scale.

This Judicial Panel having taken into account the admission of this breach by Mr Abernethy and also the submissions made by Mr Taumanu, Mr Mangos and Mr Abernethy I have also taken into account the mitigating factors as raised. A fine of $200.00 is imposed in this instance.
