An information was filed instigating a protest, the informant was Mr. T W Taumanu Stipendiary steward and this was a protest against horse number 4 Miss Sharvid on the grounds of causing interference after the start.

An information was filed instigating a protest, the informant was Mr. T W Taumanu Stipendiary steward and this was a protest against horse number 4 Miss Sharvid on the grounds of causing interference after the start. The relevant rule is 869, and it's sub- clauses.

The judges placings were 1^st No 4, 2^nd No 2, 3^rd No 9, 4^th no 8, 5^th No 6, 6^th No 7.

This protest was lodged by Stipendiary control on behalf of horses number 3 ( Eagles In My Pocket) placed 7^th driven by Mr. C Te Tomo, and Number 10, (Puhinui Gold) placed 11^th driven by Mr. S Butcher which were alleged to have been checked shortly after the start by Miss Sharvid

It was alleged that Miss Sharvid driven by Mr. N Chalmers caused interference to Eagles In My Pocket which in turn checked Puhinui Gold as the field raced into the first bend of this race.

Present at the hearing were Jr. horseman Mr. N Chalmers, assisted by Mr. R Lawson, Jr horseman, Mr. Chris Te Tomo assisted by Mr. M Berger and Miss N Chilcott the trainer of Miss Sharvid who represented the owners of this horse. Mr. Taumanu showed the video film of this incident and called Mr. J M Muirhead to give evidence, Mr. Muirhead stated that as the field was dispatched he saw Miss Sharvid which started from no 4 at the barrier attempting to cross to the lead and when crossing over Mr. Muirhead saw firstly Eagles In My Pocket and secondly Puhinui Gold both receive checks and gallop back through the field. It was Mr. Muirhead's opinion that Miss Sharvid driven by Mr N Chalmers had crossed to the lead when not sufficiently clear and his horse had touched the front legs of Eagles In My pocket causing this horse to break which then came back onto Puhinui Gold causing this horse to break also.

Mr. Taumanu called Mr. Te Tomo to give evidence and he stated that it was Miss Sharvid which had touched his horses legs and caused him to break. Mr. Lawson questioned Mr. Te Tomo also and asked if his horse had come out fractionally and made contact with Miss Sharved Mr.Te Tomo said it was Miss Sharvid which had struck his legs. Mr. Berger stated his horse Eagles In My Pocket had sustained an injury to it's off side leg and required veterinary treatment.

Miss Chilcott gave evidence and it was her belief that Eagles In My Pocket had run out and touched the wheel of Miss Sharvid. Mr. Chalmers gave evidence and stated that he thought he had been clear of Eagles In My Pocket .

Having heard all of the evidence as presented I find that Miss Sharvid crossed to the lead when not sufficiently clear of Eagles In My Pocket and did in fact check Eagles In My Pocket forcing this horse to break stride and in turn causing a check to Puhinui Gold.

The video of this incident on the head on shot was not clear however the side on video showed this incident very clearly and indeed showed Miss Sharvid getting her head around, coming in and striking the legs of Eagles In My Pocket, when not sufficiently clear of this horse.

There was no evidence to suggest that Eagles In My Pocket had come out and contacted that sulky wheel of Miss Sharvid.

The protest is upheld and I order that Miss Sharvid be relegated behind Puhinui Gold in 11^th place.

The amended placings are

1^st no 2,

2^nd No 9,

3^rd No 8,

4^th No 6,

5^th no 7,

6^th No 3.
