Stipendiary Steward Mr T TAUMANU laid an information following the running of Race 6,against Junior Horseman G GILLIES alleging he moved his horse MISS FIREHAWK from the running line outwards forcing RUNNING WITH FIRE wider on the track with approximately 1400 metres left to run.

--

--

Mr Gillies admitted the breach and was present for the hearing being represented by Mr M HILL.

--

--

Evidence was given supported by video tapes which clearly showed Miss Firehawk to move from the running line near the 1400 metre mark forcing Running With Fire wider on the track.

--

--

Mr Taumanu said that Mr Gillies had been cooperative and readily admitted his error and with a commitment to drive at TeAroha on Sunday sought a two week suspension following the conclusion of racing on 16th January 2005.

--

--

Mr Hill submitted that Mr Gillies was just starting out on his career and had worked hard to increase his skills to the level where he was now getting regular drive as a Junior Horseman. He clearly accepted responsibility for his actions at an early stage and with a good driving record suggested one weeks penalty

--

--

DECISION

--

--

The charge was found proven and taking into account the submissions made by both parties, Mr Gillies' driving commitments and record, his horsemans licence was suspended from the end of racing on 16th January 2005 up to the conclusion of racing on the 28th January 2005.
