An Information lodging a protest was laid by Stipendiary Steward Mr T TAUMANU on behalf of the connections of Horse 4 MYRON ( Driver Mr W FAUSETT) placed 5th by the Judge against Horse 1 THAT?S LIFE LAVRA,(Driver Mr T HERLIHY) placed 4th by the Judge,

An Information lodging a protest was laid by Stipendiary Steward Mr T TAUMANU on behalf of the connections of Horse 4 MYRON ( Driver Mr W FAUSETT) placed 5th by the Judge against Horse 1 THAT?S LIFE LAVRA, (Driver Mr T HERLIHY) placed 4th by the Judge, on the grounds of interference at the start of the race

The protest was contested and the respective drivers represented the connections

--

Evidence was given by Stipendiary Steward MrT Taumanu with reference to video tapes of the race.which showed That's Life Lavra off the front mark with Cosmic Illusion (Miss N CHILCOTT) behind on the ten metre mark and Myron further back on the twenty metre mark.

That's Life Lavra stood after the start and wa passed on the outside by Cosmic Illusion without incident.

--

Myron passed on the inside with difficulty although no contact was made and was approximately 20 lengths ahead before That's Life Lavra settled and joined the race.

--

The race was completed without further incident with That's Life Lavra finishing 4th half a length clear of Myron finishing 5th.

Mr FAUSETT gave evidence the he believed his horse's chances had been affected by the actions of That's Life Lavra and had been interfered with as he went past.

Mr Herlihy contended that That's Life Lavra had not moved and Miss Chilcott from the ten metre mark had been able to negotiate past him without hindrance. Mr Fausett's decision to drive around him on the inside had compounded the problem and had largely been of his own making

That's Life Lavra had finally entered the race approximately 20 lengths behind Myron

--

DECISION:

The poor start of MYRON was occasioned by the drivers decision to pass inside the stationary THAT?S LIFE LAVRA and interference caused by That's Life Lavra if any did not unduly affect Myron's chances

--

Accordingly the protest is dismissed and the Judges placings will stand

--
