Under Rule 870(3) and the Breaking Horse Regulations: An information was lodged by Stipendiary Steward Mr TW Taumanu against the third placing of AVALON SUNSET driven by Mr D Balle on the grounds that AVALON SUNSET was in its incorrect gate for approximately 200 m over the early stages of the race and certainly in excess of 150 m.

Mr Balle, as trainer and driver of AVALON SUNSET, was present and acknowledged to me that he represented the owner of that horse.

The protest was not contested.

Evidence was given by use of the video film of the race and this clearly showed AVALON SUNSET breaking and going into a gallop for a considerable distance in the early stages of the race and this appeared to be for nearly 200 m.
----
Taking all evidence into account and the fact that the protest was not contested, I disqualified AVALON SUNSET from 2nd place.

The amended placings are now 7 first, 1 second, 6 third, 5 fourth, 4 fifth and 8 sixth.
