Under Rule 857(7)(g): An information was lodged by Stipendiary Steward Mr TW Taumanu against Mr V Blanchard, the driver of LE SPOT alleging that Mr Blanchard failed to maintain his position on the mobile gate when he had drawn 8 on the front line.

Under Rule 857(7)(g): An information was lodged by Stipendiary Steward Mr TW Taumanu against Mr V Blanchard, the driver of LE SPOT alleging that Mr Blanchard failed to maintain his position on the mobile gate when he had drawn 8 on the front line.

Rule 857(7)(g) states “no horseman shall fail to come up into and/or maintain his position”.

Mr Blanchard was supported at the hearing by his father, Mr P Blanchard, the trainer of LE SPOT.  In response to a question from me, Mr Blanchard senior confirmed that he was present during the Stipendiary Steward’s enquiry into the matter.

Mr V Blanchard admitted the charge and was present.

Evidence was given by use of the video film of the race and this clearly showed LE SPOT drawing 8 at the mobile barrier and as the field was coming up to the starting point the horses were generally upon the barrier except for LE SPOT which started to hang back and at the time of the actual start LE SPOT was a notable distance back from the barrier.

Mr V Blanchard, when asked for an explanation, stated that his horse was shying at members of the public along the outside fence and he was concerned about pushing the horse too hard to get up behind the mobile barrier.  Mr Taumanu in response to that said that the horse had had 23 starts and that it was an experienced race horse and, as far as he was concerned, there was no evidence on the film that the horse was having any difficulty at the start and Mr Blanchard should have had it in the correct position.  For the record I note that the race book discloses that this was LE SPOT’S 18th start, but clearly it is an experienced race horse.

In regards to penalty, Mr Taumanu suggested that for a junior horseman the penalty shown in the JCA Guidelines at $250,00 was too high and on the basis that Mr V Blanchard had admitted the charge, he suggested a fine of $200,00.  In response Mr Blanchard senior complained that his son was being victimised by the Stipendiary Stewards but on viewing the film of the incident I could not see any evidence which gave any basis for this.  Mr Blanchard senior suggested that any financial penalty was unwarranted and that a warning would be more appropriate for a junior horseman.

I looked at the films several times and the films clearly show LE SPOT not keeping up with the mobile barrier and in fact dropping back as the barrier got closer to the start and Mr V Blanchard did not appear to be taking any steps to correct this.

Taking all evidence into account and on the basis that Mr V Blanchard is a junior horseman and that he readily admitted the charge, I impose a fine of $150,00 on him.
