An information was filed by Mr. N G McIntyre Stipendiary Steward alleging a breach of the rules, namely rule 869 2 (b) The information stated that horseman Mr. R Bowker drove carelessly

An information was filed by Mr. N G McIntyre Stipendiary Steward alleging a breach of the rules, namely rule 869 2 (b) The information stated that horseman Mr. R Bowker drove carelessly when allowing Candella to shift up the track resulting in checks to Marylyne Bromac (Mr. A Grayling), and Bachelorette (Mr. P Jeffries).

Mr. Bowker was present at the hearing of this information and did not admit the breach of this rule. Mr. McIntyre asked that the evidence given in the protest hearing be admitted as his evidence for this charge Mr Bowker had no objections to this. Mr. Bowker gave evidence and stated to the committee that it was the actions of his horse Candella running out which caused this interference. Mr. Bowker admitted that his horse had come out and he had attempted to straighten Candella up however Candella had come out again when under a drive with the whip and checked both of these horses in the run home. The chairman put it to Mr. Bowker that he had admitted that it was his horse had caused the interference and Mr. Bowker agreed this was so. Mr. Bowker was offered the chance to change his plea and admit the breach of this rule and Mr. Bowker indicated he now admitted the breach. Submission were heard on penalty from Mr. McIntyre and Mr. Bowker . Mr. Bowker had a clear driving record with no breaches of any rules over the last twelve months.

Having taken into consideration Mr. Bowkers admission of the breach of this rule,and Mr. Bowkers good driving record a fine of $250.00 was imposed in this instance.
