An information was filed instigating a protest by Mr. G McIntyre Stipendiary Steward, .the information alleged a breach of rule 869 (8). The judges placings for race two were 1st No 11, 2nd No 9, 3rd No 1, 4th no 8, 5th no 2, 6th no 6.
--This protest was lodged by Mr. McIntyre on behalf of horse no 6 Marylyne Bromac driven by Mr. Grayling placed 6th by the judge, against horse no 11 Candella driven by Mr. R Bowker placed 1st by the judge. The information alleged that Candella (Mr. R Bowker), caused interference in the run home when he shifted up the track and checked Bachelorette driven by Mr. P Jeffries on to Marylyne Bromac driven by Mr. Grayling.
--Present at this hearing were Mr. R Bowker the driver of Candella, Mr. A Grayling, Mr. P Jeffries and Mr. Barr the part owner of Candella.
--Mr. McIntyre opened his case by showing the video of the run home and this showed Candella turning for home as the lead horse, on entering the home straight Candella was being challenged by Marylyne Bromac and on the outside of this horse was Bachelorette as the field progressed up the straight Candella started to run out causing interference to both Bachelorette and Marylyne Bromac when under a drive by Mr. Bowker. Mr Bowker stopped driving Candela with the whip and straightened his horse however when struck with the whip again Candella ran out once more and caused interference both to Marylyne Bromac and also to Bachelorette both drivers of these horses having to take hold of there respective horses and check out of a very tight situation.
--Candella ran out once again when struck with the whip and continued on an outward path to the finish line. Both Mr Grayling and Mr. Jeffries gave evidence and both drivers were adamant there chances were affected by the outward movement of Candella and both these drivers stated they had both suffered interference in the run home. Mr. Bowker gave evidence and stated to the committee that it was the tendency to run out of his horse Candella that had caused the tightening and he had straightened his horse immediately this had happened.
--Decision and Reasons
--Having taken into consideration the video evidence as presented and also the evidence of both drivers of the effected horses Mr. Grayling and Mr. Jeffries this committee finds that Candella caused the interference as alleged.
--Mr. Bowker has admitted that his horse has come out and checked both of these horses.
--This interference has cost both Bachelorette and Marylyne Bromac a higher finishing place in this race as a result of the outward movement of Candella.
--For all of the above reasons this committee finds the charge proven and orders that Candella be relegated to 6th place behind horse no 6 Marylyne Bromac.
--The amended placings for this race shall now read 1st No 9, 2nd No 1, 3rd No 8, 4th No 2, 5th No 6, 6th No 11.
