An information was filed by Mr. N G McIntyre Stipendiary Steward alleging a breach of the rules, namely rule 869, 6. (b) & (c) the Push Out Rule The information stated that horseman

Mr. M McKendry forced Ruthless Charm (Miss N Chilcott) to race wider on the track with approximately1400 meters to run. Mr. McKendry was present at the hearing of this information and did not admit the breach of this rule. Mr. McIntyre opened his case by requesting that the evidence given in the protest hearing be his evidence in this charge. Mr. Mckendry had no objections to this request. Mr. Mckendry gave evidence and was still adamant that Miss Chilcott could have and should have dropped in and taken a trail behind his horse. Mr. McIntyre reminded Mr. Mckendry that he was a senior horseman of many years experience and he was well aware of the push out rule and the objectives of this rule.

Having taken into consideration the evidence given at the protest hearing and the evidence given at the hearing of this charge this committee finds the breach of rule 869. 6 (b) & (c) Proven.

Submissions were heard from Mr. McIntyre and Mr. Mckendry on penalty and Mr. McKendry's driving record showed no breaches of this rule on his record. Mr. McIntyre sought a fine of $250.00 the standard fine for a first breach of this rule.

This Judicial committee imposed a fine of $250.00 in this instance.
