Mr Mosely admitted the charge and it is found proved.

Facts:

Following the running of race 3 the Temuka Transport Handicap stewards charged Mr T Moseley (BELLE HOPE) with a breach of excessive use of the whip in that he “…used his whip excessively PRIOR TO THE 100 METRES.”

Rule 638 (3) (b) (ii) reads: A Rider shall not:

(b) strike a horse with a whip in a manner or to an extent which is:

(i) unnecessary (ii) or excessive (iii) or improper

The guidelines read: Without affecting the generality of Rule 638(3)(b), a rider may be penalised if their whip use is outside of the following guidelines: Inside the final 600 metres of a race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached.

Mr Moseley admitted the charge and appeared at the hearing.

Mr Davidson said BELLE HOPE was challenging for the lead wide out in the home straight. Mr Moseley was observed to strike his mount six times with the whip, then pause briefly, then 3 strikes prior to the 100m.

Mr Moseley said he needed to break up his whip action better.

Submissions for Penalty:

Mr Davidson stated it was Mr Mosely’s second breach of the rule within 12 months and sought a $500 fine.

Mr Mosely accepted a fine was appropriate.
