Facts:

Stewards charged training partners Mrs N White and L Callaway following the late scratching of Braceurself in Race 5. Braceurself was a late scratching, under r534 (1), after the 7.30am deadline on raceday after it was found that co-trainer L Callaway was in breach of r333 (2) (b). Mrs White appeared at the hearing and admitted the charge.

Mr Davidson stated that under r333 (2) (b) Mr Callaway could not ride Shutthefrontdoor as he had a second runner in the same race, Braceurself. He was a part-owner of both horses and under the Rule he was ineligible to ride in the race. When notified the partnership had options to get another rider for Shutthefrontdoor. However, there were no suitable riders available and they decided to scratch Braceurself. He said Mr Bothamley had lost half his riding fee due to the late scratching.

Mrs White stated that neither partner were aware of the Rule. They decided to scratch Braceurself as the partners had put a lot of work into Shutthefrontdoor, which could be difficult to ride. She also said they were disappointed that the error wasn’t picked up at the time of nominations.

Submissions for Penalty:

Mr Davidson said fortunately no horses were denied an opportunity due to the late scratching. However, Mr Bothamley lost half his riding fee. He said the partnership had a similar late scratching charge 12 months ago. Stewards sought a fine between $150 and $200.
