REQUEST FOR A RULING  INFORMATION NO:  40103  RULE NO:  1102(2)(ii)

An Information was lodged by Stipendiary Steward Mr JM Muirhead making application to the Judicial Committee to seek a Ruling as to whether the remainder of the Meeting should be abandoned due to safety concerns expressed by the Drivers and by the Stipendiary Stewards.

Rule 1102(2)(ii) provides:

--

“The functions of a Judicial Committee shall be to determine any question as to whether that day of racing or any part thereof shall be postponed, abandoned or cancelled.”

--

Mr Muirhead advised this Committee that he had had representations from Senior Horsemen following the running of Race 1, the Horsemen expressing concerns about excessive water lying on the track and visibility being bad as a result of the persistent heavy rain.

Mr Muirhead had spoken to Horsemen P Ferguson, AG Herlihy, J Stormont, J Abernethy and G Robb.

Mr Muirhead showed the Committee a replay of Race 1 and quite clearly there was excessive surface water on the track in several positions and particularly approximately 150-200 metres from the finishing line.   This caused horses to break from their gait when they went through it.   Mr Muirhead also pointed to the state of the crossing to inside tracks which had been covered but the covering was disappearing as a result of the rain.   The crossing was becoming very slippery.

The Committee heard from Messes Stormont, Abernethy and Robb who expressed their concerns about the state of the track and the fact that visibility out on the track was very bad.   Club Officials also expressed their concern.   The Committee was aware that the weather forecast for the day was for persistent heavy rain all day and that a heavy rain warning had been issued for the Bay of Plenty area.

The Committee ruled that the track and racing conditions were unsafe and that racing should be abandoned for the day on the grounds of Safety to Horsemen and Horses.
