Stipendiary Steward Mr T TAUMANU lodged an information instigating a protest following the running of Race 8 on behalf of the connections of Horse 4 BENALLIA (M STORMONT), placed 6th by the Judge against horse 7 DAVBRO BROMAC (N CHILCOTT),placed 4th by the Judge

Stipendiary Steward Mr T TAUMANU lodged an information instigating a protest following the running of Race 8 on behalf of the connections of Horse 4 BENALLIA (M STORMONT), placed 6th by the Judge against horse 7 DAVBRO BROMAC (N CHILCOTT),placed 4th by the Judge alleging there was interference approximately 200 metres after the start of the race.

Drivers were present to represent the connections.

Mr Taumanu in referring to Video tapes of the race explained that DAVBRO BROMAC was hanging badly shortly after the start of the race and at about the 200 metre mark when immediately outside BENALLIA had moved down and forced BENALLIA against the rails, the horse subsequently breaking. There appeared to be contact between the horses but both Mr Stormont and Miss Chilcott confirmed there had not been, although BENALLIA's cart had hit the rail.

Mr Stormont was reluctant to attribute blame to Miss Chilcotts driving or the horse as he was intent on his drive. He did confirm however that his horse's actions did not contribute to the interference and that DAVBRO BROMAC had his head at about 45 degrees to his track at the time the interference occurred. He could not comment on Miss Chilcotts actions.

In his opinion if positions had remained as they were at the time of contact he was confident of gaining a third or fourth placing.

Miss Chilcott conceded that DAVBRO BROMAC had been hanging badly but was reluctant to accept that her driving or the horse's behaviour had contributed sufficiently to cause BENALLIA to break.

--

Alllthough the tapes did not clearly assist the enquiry, DAVBRO BROMACS actions could be seen sufficiently to support the protest and the version of events extracted from Mr Stormont and comments from Miss Chilcott removed any further doubt.

--

The Protest was upheld and DAVBRO BROMAC was relegated to 6th place immediately behind BENALLIA.
