An information was lodged by Stipendiary Steward Mr T TAUMANU against Junior Horseman Mr R DOWNEY following the running of Race 6 alleging he drove SANTA NITA carelessly
| -- An information was lodged by Stipendiary Steward Mr T TAUMANU against Junior Horseman Mr R DOWNEY following the running of Race 6 alleging he drove SANTA NITA carelessly when he allowed her to move inwards causing a check to JENNY?S WISH (T SHAW) with 450 metres to run, JENNY?S WISH subsequently breaking. ----Mr Downey was supported by Mr Errol Downey and admitted the breach. ----Evidence was given by Mr Taumanu who referred to Video recordings of the race. It was clear that Mr Downey was following MISS GOLDEN GAIT (S FENNING) into the home straight. As he did so he moved towards the rail closing out JENNYS WISH. Contact could not be confirmed but JENNY?S WISH was forced onto the rails and subsequently broke and lost all chance. ----The Charge was established and following submissions on penalty all parties conceded that 2 weeks suspension was appropriate in the circumstances ----PENALTY ----Mr Downey received two weeks suspension commencing after the last race on 30th January 2005 and concluding following the end of Racing on 13th February 2005. ------ -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- --
