Following the running of Race 6 an information was lodged by Stipendary Steward Mr T Taumanu, alleging a breach of Rule 869 (3) b careless driving.

The information alleged that Junior horseman, Mr A Sharpe, drove ?Mystery Sands' carelessly



Following the running of Race 6 an information was lodged by Stipendary Steward Mr T Taumanu, alleging a breach of Rule 869 (3) b careless driving.

The information alleged that Junior horseman, Mr A Sharpe, drove ?Mystery Sands' carelessly, striking the wheel of the sulky of ?Hanover Ace? (N Chalmers), causing his own horse to break with resultant interference to ?Benromach?, dislodging A Stormont from the sulky.

Mr A Sharpe did admit the breach.

Mr A Sharpe was present during the hearing.

--

Mr A Sharpe was assisted by Senior horseman S Phelan.

Mr Taumanu demonstrated the incident by use of video film. ?Mystery Sands' was in the trail behind ?Hanover Ace? shortly after the start. It was visible on the video film, that ?Mystery Sands' struck the wheel of ?Hanover Ace? causing his own horse to break with resultant interference to ?Benromach? who was following 3 back on the rails, causing driver A Stormont to be dislodged from the sulky.

Driver A Stormont was taken to Tauranga Hospital for observation.

Mr Taumanu had concerns that junior horseman A Sharpe did not know his horse hit a wheel.

--

Mr Taumanu gave Mr Sharpe some advice on how to handle himself when being interviewed by Stipendary Stewards in the future.

--

Mr Phelan stated that the leader had run out slightly and that ?Mystery Sands' was traveling keenly and there were contributing factors involving the incident.

--

Mr A Sharpe when asked for his interpretation, advised he had nothing to offer.

--

Penalty

--

Mr Taumanu recommended a 1 month suspension and advised Mr A Sharpe to gain more experience at the trials.

--

Mr A Sharpe had a clean driving record and when asked by the committee stated he had had approximately 30 drives in the season.

--

In fixing penalty, the committee took into account the following;

--

--

1. The guilty plea

--

2. The submissions of Mr Taumanu

--

3. The submissions of Mr Phelan

--

4. The consequential effects of this horse hitting a wheel.

--

5 Mr A Sharpe clean driving record

--

--

 

--

The committee, after taking all matters into account, suspends Mr A Sharpe up to and including 28 February 2007.
