Facts:
Following the running of the HEATING SYSTEMS MOBILE PACE an Information was lodged by Stipendiary Steward Mr JM Muirhead against Licensed Driver Ms N Chilcott alleging that Ms Chilcott breached the Pushout Rule with 1100 metres to run by forcing LING HU (Driver L Hollis) to race wider on the track.
Ms Chilcott advised the Committee that she admitted the charge and did not wish to be present at the Hearing.
The film and oral evidence taken at the Protest Hearing was applied to this Hearing.
Submissions for Penalty:
Mr Muirhead said that the aggravating feature was that Ms Chilcott's actions had caused a relegation of her horse and as such he referred to the penalties in the JCA Guidelines. He did say in mitigation however that Ms Chilcott had admitted the breach and that she was a busy Driver and had a very good record.
He also submitted that the incident was at the lower end of the scale and that a fine of $200.00 was appropriate.
Reasons for Penalty:
The Committee has assessed the evidence and as far as we are concerned we agree with Mr Muirhead's submissions and that the level of fine submitted by him is appropriate. We see this as being an error of judgement by Ms Chilcott.
