Facts:
Following the running of the HEATING SYSTEMS MOBILE PACE an Information was lodged by Stipendiary Steward Mr JM Muirhead against Open Horseman Mr S Dickson alleging that Mr Dickson drove ACES FELLA carelessly causing interference to LING HU (Driver L Hollis) with 150 metres to run.
Mr Dickson was present at the Hearing and he advised the Committee that he admitted the breach but with mitigating circumstances.
It was agreed by the parties that the film and oral evidence used at the Protest Hearing could be accepted as evidence for this Hearing.
Submissions for Penalty:
Mr Muirhead said that the JCA Guidelines provide that where a Driver's actions cause a relegation then the starting point penalty is either suspension of Licence for 10 drives or a $500.00 fine.
He did say that Mr Dickson has admitted the breach and has a good record and he submitted that a fine of $300.00 would be appropriate.
Mr Dickson said that he had already been disadvantaged as a result of the relegation because he part owns and trains ACES FELLA. He has lost money as a result and he asked the Committee to take that into consideration.
Reasons for Penalty:
The evidence presented to us is clear and although Mr Dickson did not interfere with the chances of Mr Hollis' horse he did gain an advantage from his actions. He has simply moved too soon and although this was at the business end of the Race he would have been better to have waited until he had sufficient room.
We have taken into account the mitigating factors and we take the view that this is not the worst incident of interference that we have seen. We have looked at the starting point penalty and we also have the benefit of JCA Penalty Schedules which showed a recent fine of $300.00 for a charge of interference causing a relegation. In the interests of consistency we will impose the same level of fine on Mr Dickson.
