An information was filed following race number five alleging a breach of the rules. The informant was Mr .T.W.Taumanu Stipendiary Steward and the defendant Mr. J.Abernethy.

This was an alleged breach of rule 869 (1) which states “No Horseman shall look around unduly during any race”.  The information stated that Mr.J.Abernethy the driver of “Jackpot Gold “looked around unduly during this race approximately 12 times.



An information was filed following race number five alleging a breach of the rules. The informant was Mr .T.W.Taumanu Stipendiary Steward and the defendant Mr. J.Abernethy.

This was an alleged breach of rule 869 (1) which states “No Horseman shall look around unduly during any race”.  The information stated that Mr.J.Abernethy the driver of “Jackpot Gold “looked around unduly during this race approximately 12 times.

Mr J.Abernethy admitted the breach of this rule and was present at the hearing.

Mr. Taumanu showed the video of  the final 600meters of this race and it could clearly be seen that Mr .Abernethy had looked around at least 12 times as alleged.

Mr Taumanu made submissions on penalty and sought a monetary penalty of $200.00 in this instance taking into account the admission of the breach of this rule by Mr.Abernethy.

Mr Abernethy made submission on penalty and agreed with the $200.00 fine

Having taken into account the admission of the breach of rule 869(1) by Mr.Abernethy and also having perused the JCA guidelines as to a penalty for this offence a fine of $200.00 is imposed in this instance.
